Ende 2020 wurde in Brandenburg eine wichtige Anpassung der Regelungen zur Maklerprovision vorgenommen, die erhebliche Auswirkungen auf Käufer und Verkäufer hat. Vor dieser Reform musste der Käufer die gesamten Maklerkosten alleine tragen. Die neuen Bestimmungen zur Maklerprovision beschränken sich auf die Vermittlung von Eigentumswohnungen und bestimmten Hausarten wie Einfamilienhäuser, Doppelhaushälften und Reihenhäuser. Bei der Vermittlung von Mehrfamilienhäusern, unbebauten Grundstücken und Gewerbeobjekten können die Provisionskosten jedoch weiterhin individuell ausgehandelt werden, wobei der Käufer die Möglichkeit hat, alle Kosten zu übernehmen.
Wie hoch ist die Maklerprovision in Brandenburg?
Die Maklerprovision in Brandenburg wird durch den Wert der Immobilie, den beauftragten Makler und die regionalen Gesetze bestimmt und liegt gewöhnlich zwischen 3,57% und 7,14% des Kaufpreises. Es ist üblich, dass Käufer und Verkäufer sich die Courtage teilen, sodass jeder höchstens 3,57% zahlt. Wenn der Makler mit beiden Parteien Verträge abgeschlossen hat, wird die gesamte Provision von 7,14% geteilt, was bei einem Kaufpreis von 500.000 Euro für jeden einen Betrag von 17.850 Euro bedeutet.
Wie sieht es bei der Vermietung von Immobilien aus?
Im Vermietungsprozess regelt das Bestellerprinzip die Zahlung der Maklerprovision. Nach diesem Prinzip übernimmt derjenige die Kosten, der den Makler engagiert hat, üblicherweise der Vermieter.
Diese Regelung wurde eingeführt, um Mieter davor zu bewahren, hohe Maklergebühren zu zahlen, wie es vor der Einführung des Bestellerprinzips der Fall war. Heutzutage liegt die finanzielle Last in der Regel beim Vermieter.
Die Höhe der Maklerprovision entspricht normalerweise zwei Kaltmieten plus 19% Mehrwertsteuer, also etwa 2,38 Monatsmieten, kann jedoch abhängig von individuellen Absprachen unterschiedlich sein.
