Buying a house is exciting, so it's all the more important that you feel you're in good hands. Do you know a notary? Great - a good recommendation gives you confidence, even if the notary must always be neutral. If you would like to have the draft contract checked in advance, hire a lawyer with specialist knowledge. The final purchase contract is then signed on the day of notarization. The notary will recite the following word for word: the negotiated purchase price, the transfer modalities and the payment procedure. By the way: We advise everyone not to hand over the keys before the money has been paid.
Tip: There are special agreements such as "preparatory construction measures". If you grant the buyer this option, have this noted in the notary contract. If the future owner has to enter the house for this purpose, e.g. to take measurements, accompany them.
Meter readings and responsibilities
The owner has a duty to ensure safety - i.e. as long as the buyer has not taken over the house, the seller is responsible for the safety around the house. And: Don't forget all the paperwork - remember to take meter readings and re-register your insurance. However, some invoices will only be sent to the new owner once they have been entered in the land register. This can take a few months after the transfer, e.g. for property tax. However, you can pass on all costs received from this point onwards to the buyer on a 1:1 basis - including pro rata advance payments, e.g. for building insurance.
Tip: As the buyer, you have a four-week special right of termination to change the building insurance after the transfer of ownership. The extract from the land register is required as proof of this.
Purchased as seen
As a general rule, the property is handed over vacated and swept clean. As the seller, you therefore do not have to clean up or renovate. Unless otherwise agreed. Also bear in mind that everything that has a function must remain - from the toilet roll holder to the tap to the garden plant. You are no longer allowed to dig up the enchanting rose bush without consulting the buyer. As the seller, you should also pass on all keys, access codes and documents to the buyer. The five-year guarantee for the conservatory built three years ago may well be helpful for the successor. Incidentally, all movable items are not automatically included. Individual agreements apply here.
Tip: As the seller, you should know that the condition of the property must not have deteriorated between the time of the viewing and the time of handover.
